Rental and tenant-occupied property
Done Being a Landlord?
You do not have to evict anyone, wait out a lease, or repaint between tenants. Send us the lease and we will work around it.
- We buy tenant-occupied, including holdover and month-to-month
- No eviction required and no notice period to wait out
- Unpaid rent and tenant damage do not stop the sale

The Short Answer
Yes, you can sell a tenant-occupied rental in Florida, and you do not need to remove the tenant first. In Florida a lease survives the sale, so the buyer takes the property subject to the existing tenancy and receives the security deposit. That is exactly why selling to a cash buyer who intends to keep the property as a rental is simpler than listing it: a retail owner-occupant buyer usually needs the house vacant, which puts the whole transaction at the mercy of your tenant’s lease term.
The problem with listing a tenant-occupied house
Most retail buyers want to live in the house. That means they need it empty, which means you need the tenant out, which means either waiting for the lease to end or starting a removal process. And in the meantime the listing requires showings, which requires the tenant’s cooperation, which you may or may not have.
Tenants who know the house is being sold out from under them are not usually motivated to keep it photogenic. It is one of the most common reasons a rental listing sits.
What we take on
We buy rentals to keep them as rentals, so a tenant in place is a feature rather than a defect. We take assignment of the lease and the security deposit at closing, and your tenant is not disrupted.
- Active lease with months left to run
- Month-to-month and holdover tenants
- Tenants who have stopped paying
- Section 8 and other housing assistance tenancies
- Significant tenant damage
- A partly occupied duplex or fourplex
Send us the lease, the current rent, the deposit held and the payment history. That is the file.
Why Florida landlords are selling
Across our markets the same three reasons come up. Insurance premiums on rental property have climbed hard since 2022 and in some counties carriers simply will not write at all. Property taxes on a non-homestead property reassess at full market value on transfer and do not enjoy the Save Our Homes cap. And the maintenance on a 1970s block house does not get cheaper with time. When the numbers stop working, the exit should not take six months.

Questions
Questions sellers ask us
Do I have to tell my tenant I am selling?
Your lease governs notice and entry, and you should follow it. The sale itself does not require the tenant’s permission, and in Florida the lease survives the change of ownership.
What happens to the security deposit?
It transfers to us at closing, usually as a credit on the settlement statement, and we take on the obligation to return it under Florida law.
My tenant has not paid in three months. Still interested?
Yes. Tell us where things stand and whether any legal action has been filed. It affects our number, not our willingness.
Can you buy several properties at once?
Yes. Send the addresses in a list and we will price them together. A portfolio closing in one transaction is usually simpler for everyone than five separate ones.
Will you do a 1031 exchange?
We can accommodate a seller doing a 1031 exchange, but the timing is strict and your qualified intermediary has to be engaged before closing. Tell us at the start, not the week of.
What about the depreciation recapture?
Selling a rental you have depreciated usually triggers recapture taxed at a different rate than capital gains. We are not tax advisors. Talk to your CPA before you sign anything, and factor it into whether the sale makes sense for you.
